What contracts should be concluded?

  • Rent contract:
A lease agreement must be entered into for the facilities in the nursing home community. As a rule, residents individually sign a lease agreement with the landlord. However, it is also possible for the community as a whole to agree on a lease with the owner.
  • On-site worker services contract:
A nursing home community is characterized primarily by the fact that the residents living there need help and support in everyday life. Residents therefore order common person (or several people) who stays in the apartment during the day, takes care of the residents and organizes and manages daily life, offers activities and provides support at home. These general care and support services provided by a so-called “face-to-face worker” are contractually agreed. In a shared apartment specializing in people with dementia, staff must be present in the apartment 24 hours a day – including at night.
  • Nursing service contract:
Residents requiring care also enter into an individual care contract with a care service for certain services in order to cover their personal care needs. Residents of a nursing home community should be able to freely choose the nursing facility in which they wish to be cared for. If residents also need help with taking medication, for example, a contract for so-called treatment care must be concluded with a nursing service.
  • Care and support services contract:
It is also conceivable to transfer nursing care not to a nursing service, but to an assistance service. This should be considered especially in cases where the amount of the benefit in kind has already been exhausted but the need for assistance is not covered or in the case of people with Level of care 1 who are not entitled to assistance benefits in kind. The care service can be ordered both individually and jointly by the members of the shared apartment.
  • Community agreement:
Finally, it is also advisable to reach a joint agreement that regulates coexistence in the nursing home community. The content of this community agreement depends, in particular, on whether it is a self-organized nursing home community or one organized by a provider.

Costs of a Shared Nursing Home

In a nursing home community, there are costs for the apartment, daily cleaning (e.g. food, cleaning products, etc.), care (staff) and, if necessary, nursing care. The total costs of a place in a nursing home community are generally comparable to the costs of a place in a nursing home.

How much does nursing care insurance pay?

The residential group surcharge

Those requiring care in nursing communities that meet certain requirements are entitled to a residential group surcharge of 214 euros per month. As the residential group surcharge is linked, it serves to pay people who have been hired by the residents of the shared apartment to stay in the shared apartment during the day and provide assistance and support services (face-to-face worker).

In the past, the group home surcharge has been rejected by care insurers for a number of reasons. The Federal Social Court has in different judgments decided that the granting of the residential group subsidy should not be subject to excessive requirements. However, the prerequisite is always that it is a shared apartment and not inpatient care (such as in a nursing home). The living group supplement is granted upon request if the person in need of care has:

  • at least two and at most eleven other people live,
  • Lives in a shared apartment in a group home that is attended to by outpatient staff,
  • lives and lives for the purpose of community-organized nursing care
  • of which at least two other people require care, i.e. at least assigned to care level 1.

People who do not (yet) require care can also join the community group. These residents must be taken into consideration when determining the size of the residential group. However, they are not (yet) entitled to the residential group supplement due to lack of care.

Initial allowance for shared apartment

Under certain conditions, those in need of care and who create a nursing home community or are at least involved in it receive a lump sum of 2,500 euros per person as initial financing. Overall, funding is limited to a maximum of €10,000 per nursing home community. All measures aimed at permanently improving an age-appropriate or barrier-free living situation can be financed, for example. B. installation of a floor-level shower and widening of the door. Renovation works can be carried out before the company is founded and moved.

In practice, nursing care insurance companies often reject these services. The reason given for rejection is that there is a way of life that corresponds to full-time hospitalization or that there is no active involvement of residents or their environment. Both must, therefore, be expressly regulated in the contract.

Renovations in the shared apartment

Sometimes additional renovations may be necessary to adapt the living area to the individual needs of those requiring care. For example, a stair lift may be needed in a multi-story home. Nursing care funds subsidize these measures to improve the living environment upon request, with up to 4,000 euros per measure.

However, age-appropriate or barrier-free reframing is not sufficient for this support. Rather, the construction project must first enable home care or facilitate the current care situation of the person needing care or restore a lifestyle that is as independent as possible. Grants can be combined for multiple people who need care.

The maximum amount is 16,000 euros per nursing home community. The assistance fund checks individually for each person in need of care whether the requirements for improving the living environment are met.

Care and nursing allowances

If care is organized through outpatient care services, care insurance funds provide in-kind care benefits for those who require care with at least care level 2. The amount of the subsidy depends on the level of care that was provided. determined for you.

Health insurance also generally offers benefits similar to private life, such as home care (e.g. medication administration, wound care).

Furthermore, the can also Relief value from 125 euros can be claimed. This amount is available to all those requiring care in care levels 1-5. It is important that this amount can only be used for nursing service relief offers or services enabled by current state legislation.

What to do if your income is not enough?

Despite the services described, residents themselves have to pay most of the costs. If you have no income or assets of your own, the social welfare office sometimes intervenes. If it is foreseeable that part of the costs will probably have to be financed by the social assistance service, you should clarify before moving in whether the social assistance service will also pay for the stay in the selected shared apartment. People on low incomes can also apply for housing benefit.

In the past, social services deducted the group life supplement as benefit income. O Federal Social Court However, it decided that the group living supplement cannot be credited towards assistance benefits because it is not used to provide individual nursing care to the beneficiary. Those affected must inform the social welfare service about this.
